US Copyright Office rules jailbreaking, some DRM circumvention legal
The United States Copyright Office, which reviews the DCMA (Digital Millennium Copyright Act) every three years, has made several notable exemptions to the act this year. The exemptions include: bypassing the CSS (Content Scrambling System) in DVDs in certain circumstances; unlocking or jailbreaking cellular phones (including the iPhone), the breaking of DRM in video games under certain circumstances and the breaking of DRM in e-books in order to enable read-aloud or special text functionality.
Unlocking network locked phones in order to enable different cellular carriers and jailbreaking a handset in order to install other operating systems are now both legal. Apple has been very vocal about this ruling since iPhone users will, if they choose, no longer rely solely on the App Store in order to install new software. Apple has pointed out that jailbreaking their handset will invalidate the iPhone’s warranty.
People in the States may bypass a DVD’s CSS system in order to use short clips of a film: for educational purposes by college and university students and professors, for documentaries and for non-commercial videos. Video game DRM may now be bypassed if the purpose is: investigating or testing security vulnerabilities that the DRM may contain or introduce into a system, as long as the information that is discovered is used in accordance with the game’s copyright. The DRM used by e-books may be circumvented if that DRM prevents the book from being read aloud by a computer program or if it prevents specialised screen functionality for the sight impaired.
